ANALYSIS OF JUDGE RULINGS AND LEGAL CONSIDERATIONS IN GRANTING POLYGAMY PERMITS IN SOURCE RELIGIOUS COURTS IN 2022

Abstract

One form of marriage that is often discussed in society because it contains controversial views is polygamy. Polygamy requires permission from the relevant parties and the local religious court to avoid misunderstandings. This article discusses the judge's decision and the legal considerations applied in granting permission for polygamy at the Sumber Religious Court in 2022. With the aim of knowing the legal basis used by the panel of judges in granting permission for polygamy. This article uses a type of field research with a normative juridical approach. This research was conducted at the Pengadilan Agama Sumber. The results of this research explain that in cases of polygamy applications accepted by the Sumber Religious Court there are several reasons behind the parties submitting it, namely the condition of the wife having an incurable disease and being unable to give birth to offspring, the wife suffering from strokes and the wife frequently refusing to have relations like husband and wife.
